1. Acceptance of Terms

By accessing and using kivi.gg and the Kivi platform, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. AI Disclaimer & Limitation of Liability

Critical Technical Disclaimer:

Kivi LTD utilizes advanced Artificial Intelligence (AI) and Large Language Models to build websites, generate content, and provide information inside the platform. You acknowledge and agree that:

  • AI-generated content and responses are for informational purposes only and do not constitute professional, legal, or financial advice.
  • While we strive for accuracy, AI models may occasionally produce incorrect, incomplete, or biased information ("hallucinations").
  • Kivi LTD shall not be liable for any loss or damage arising from your reliance on information or content produced by our AI systems.
  • You are responsible for reviewing AI-generated content — including pages, posts, emails and prices — before you publish or act on it.

3. Subscriptions & Billing

Paid plans are billed as recurring subscriptions through our payment provider (Stripe). Prices are set separately in pounds, euros and US dollars, and you are charged in the currency shown at checkout, with VAT or sales tax added where it applies. You can cancel at any time, and your plan remains active until the end of the period already paid for. Anything you have built stays yours after cancellation, on the free plan's terms.

4. AI Allowance & Usage Credits

  • The Pro plan includes an AI allowance for each billing period, shared across the platform's AI features. Your usage is shown as a percentage in Settings → Billing. Unused allowance does not carry over to the next billing period.
  • Usage-based billing is optional on Pro. When it is switched on, AI use beyond your allowance is paid from usage credits, which you buy in advance ("top up") in any amount from 10 in your billing currency (GBP, EUR or USD). AI Social is always paid from usage credits.
  • When your usage credits run out, AI features beyond your allowance pause until you top up again or your allowance renews.
  • Usage credits do not expire and carry over from one billing period to the next. They can only be used while you are on the Pro plan, and they stay on your account if your plan ends. Deleting your account deletes any unused usage credits.
  • All purchases of usage credits are final and non-refundable. Usage credits are made available immediately after payment. By completing a top-up you expressly ask for them to be supplied straight away and acknowledge that you lose your right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and equivalent rules elsewhere.

5. Intellectual Property

The Kivi platform — including its software, design, templates, and branding — is the property of Kivi LTD or its content suppliers and is protected by UK and international intellectual property laws. The content you create and upload to your own sites remains yours.

6. Governing Law

These Terms of Service and any dispute or claim arising out of them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England shall have exclusive jurisdiction to settle any such dispute.
